Terms of Service

The MPlayerLeague (MPL) provides service to its users subject to the Terms of Service (T.O.S.) which may be updated without prior notice and acceptance by the user. MPL provides it's users with a competitive online gaming service including numerous game platforms that are subject to change without prior notice to the user. Usage of the service requires access to the World Wide Web by user provided equipment and user provided internet access service.

At the time of member signup for the MPL service, you agree to provide certain information such as name, address and email address. This information is not for sale, transmission, distribution or any other form of use other than that of MPL. The user is expected to provide accurate and truthful information and failure to do so may result in the user losing access on a temporary or permanent basis at the discretion of MPL Management to the use of the MPL service. MPL does cooperate with law enforcement and lawfully constituted legal entities and violation of state or U.S. law may result in transmission of personally identifiable data in accordance with state or federal investigations into any unlawful activity.

Anyone under the age of 13 is considered a child by U.S. law and MPL will not accept as a user any person under the age of 13.

In return for use of the service, users agree to abide by certain rules of conduct. Failure to do so may result in the users access to the service being revoke on a temporary or permanent basis. The following is provided as expressly prohibited conduct but is not intended to be all inclusive. Any conduct deemed to be offensive or inappropriate to the MPL community may result in revocation whether listed or not. MPL reserves the right, but does not assume responsibility, of monitoring its services for violations of these rules of conduct.

Discrimination based on race, sex, religion, or ethnic origin will not be tolerated.

Harassment, slander, racial/ethnic slurs, callsigns, unit names, or public posting or speech will result in revocation of use of the service.

Any conduct which is specifically known to be a violation of state or federal laws to include but not be limited to: pirated software discussion, sharing or links to same; obscene or libelous pictures, art, or post; "Hacking" or threatening to "hack" the MPL service or any user thereof.

Exploiting or attempting to exploit minors in any means.

Impersonate any user or member of the MPL staff or management.

Use the MPL service for commercial promotion without formal contact with MPL Management to arrange commercial affiliation.

Any other conduct found to be harmful to the operation of MPL at the determination of MPL Management.

The user agrees to hold MPL, MPL owners, management, volunteers or affiliates blameless for any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the MPL service, your connection to the service, your violation of the T.O.S., or your violation of any rights of another.

The user agrees not to duplicate, copy or use as their own, any content that is the property of MPL including but not limited to: Graphics Rules or Game Types Any Documentation Any other item that is the property of MPL. MPL reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the MPL service or any part thereof with or without notice. You agree that MPL will not be liable to you or to any third party for any modification, suspension or discontinuance of the MPL service.

The user agrees that at the sole discretion of MPL, MPL may terminate your password, use of the MPL service for any or no reason, including, without limitation, if MPL believes that you have violated or acted inconsistently with the provisions of the T.O.S.. MPL may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the service under any provision of this T.O.S. may be done without prior notice. The user also agrees that MPL shall not be liable to the user for any termination of your access to the service.

MPL runs advertisements and promotions on MPL web sites. The user agrees that MPL has the right to run such advertisements and promotions. The manner, mode and extent of advertising by MPL is subject to change. Your business dealings with, or participation in promotions of, advertisers found on MPL sites, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. The user agrees that MPL is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the MPL service.

The user acknowledges and agrees that the MPL web sites contain proprietary and confidential information that is protected by applicable intellectual property and other laws. User further acknowledges and agrees that advertisements or information presented to you through the MPL service or advertisers is protected by copyrights, trademarks, service marks, or other proprietary rights and laws.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MPL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. MPL MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,

THE USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO THEIR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE USE OF THE MPL SERVICE.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY THE USER FROM MPL OR THROUGH OR FROM THE MPL SERVICE SHALL CREATE ANY WARRANTY.

THE USER UNDERSTANDS AND AGREES THAT MPL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT OR INCIDENTAL DAMAGES, INCLUDING BUT NOT LIMITED TO, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE.

The failure of MPL to exercise or enforce any right or provision of the T.O.S. shall not constitute a waiver of such right or provision.

The T.O.S. and the relationship between MPL and the user will be governed by the laws of the State of California. MPL and the user agree to submit to the jurisdiction of the courts located within the state of California. If any provision of the T.O.S. is found by a court of competent jurisdiction to be invalid, the other provisions of the T.O.S. remain in full force and effect.

The name MPlayerLeague and its associated graphics, forms, web site content or any other material on the MPL website is the intellectual property of MPlayerLeague and any unauthorized use, copying or redistribution without the express written consent of MPL is prohibited.
